These terms cover your use of the QuestDay mobile app ("the app"). By downloading or using the app, you agree to them. If you don't agree, please don't use the app. This agreement is between you and Robert McFarlane ("we", "us", "the developer") only, and not with Apple Inc. Apple is not a party to this agreement and has no responsibility for the app or its content.
We grant you a personal, non-exclusive, non-transferable licence to use the app on any Apple-branded products that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions, for your own personal, non-commercial use. Where permitted by Apple, the app may also be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.

You must also comply with any applicable third-party terms that apply to you while using the app — for example, your mobile carrier's data or service agreement.
You don't need an account to use QuestDay — signing in to QuestDay Online is optional. If you do create one, you're responsible for keeping your login credentials confidential and for all activity that happens under your account.
QuestDay's Team feature lets you connect with other players by sharing or entering an invite code. Once connected, certain stats (your hero name, weekly XP, streak and earned badges) become visible to that connection, as described in our Privacy Policy. Don't use the Team feature to harass, abuse, or spam other players. We may suspend or terminate accounts that abuse the Team feature or otherwise break these terms. You can request deletion of your account and its data at any time by contacting us (see Section 12).
QuestDay may offer an optional paid upgrade ("QuestDay Pro"). Any purchase is billed through the Apple App Store or Google Play and is governed by that store's terms. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel a subscription anytime in your store account settings.
We are solely responsible for the app and its content, and for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. QuestDay is provided on an "as is" and "as available" basis. We don't guarantee the app will always be available, error-free or uninterrupted. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you (this does not apply to subscription billing, which is handled as described in Section 4). To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to a warranty are our sole responsibility, not Apple's.
To the fullest extent permitted by law, we are not liable for any indirect or consequential loss arising from your use of, or inability to use, the app. Nothing in these terms limits any rights you have that cannot be limited under applicable law.
We, not Apple, are solely responsible for the app, its content, and addressing any claims you or any third party may have relating to the app or your possession and/or use of it, including (without limitation): product liability claims; any claim that the app fails to conform to an applicable legal or regulatory requirement; and claims arising under consumer protection, privacy or similar law. If a third party claims that the app, or your possession and use of it, infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
By using the app, you represent and warrant that you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist-supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and that, upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary of them.
We may update the app and these terms from time to time. When we do, we'll update the "last updated" date above. Continuing to use the app means you accept the updated terms.
These terms are governed by the laws of England and Wales. This does not restrict Apple's rights and obligations under the Apple Media Services Terms and Conditions in relation to you as a third-party beneficiary of these terms.
